To deliver these Services, Big Cheez Marketing uses GoHighLevel ("GHL"), a third-party customer relationship management and marketing automation platform. Through GHL, we may communicate with you, our clients, and our clients' customers via email, phone calls, voicemail drops, and SMS text messages. Consent is obtained before any SMS messages are sent, as described in the SMS Messaging Terms below.

3. User Responsibilities

When using the Site or Services, you agree to:

Provide accurate, current, and complete information when requested (including contact information used for communications through GHL)

Maintain the confidentiality of any account credentials associated with services we provide

Fees for Services are set forth in the applicable proposal, invoice, or service agreement provided to you directly by Big Cheez Marketing. Unless otherwise stated in writing:

Payments are due according to the terms specified in your invoice or agreement

Late payments may result in suspension of Services

All fees are non-refundable except as expressly agreed in writing by Big Cheez Marketing

Any recurring or subscription-based services will be billed on the schedule disclosed to you at the time of purchase.

6. Intellectual Property

All content on the Site, including text, graphics, logos, and software, is the property of Big Cheez Marketing or its licensors and is protected by applicable intellectual property laws. Deliverables created for clients (such as websites, funnels, or automations) are governed by the specific service agreement between Big Cheez Marketing and the client, which will address ownership and license rights upon full payment.

You may not copy, reproduce, distribute, or create derivative works from any content on the Site without our prior written permission.

7. Disclaimers

The Site and Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Big Cheez Marketing does not guarantee specific marketing results, search engine rankings, lead volume, or business outcomes from use of the Services.

8. Limitation of Liability

To the fullest extent permitted by law, Big Cheez Marketing shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Site or Services, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of these Terms or the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Message Frequency: You will receive up to 4 messages per month. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Opt-Out: You can cancel the SMS service at any time. Just text "STOP" to +1 623-304-5335. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carrier Liability: Carriers are not liable for delayed or undelivered messages.
